1. Nature of Services
Positive Realist provides personal development, mindset, and coaching services designed to support and empower clients in achieving self-improvement and personal goals. These services are educational and informational in nature and are not medical, psychological, financial, or legal advice.
You acknowledge that Positive Realist’s coaching is not a substitute for professional therapy, counseling, medical treatment, or financial consulting.
2. Client Responsibility and Assumption of Risk
By engaging with Positive Realist, you confirm that you are participating voluntarily and under your own free will. You acknowledge and agree that:
- You are solely responsible for your own actions, decisions, and outcomes before, during, and after the coaching program.
- You assume full responsibility and all associated risks for any choices you make as a result of coaching sessions, materials, or recommendations.
- Positive Realist and its representatives are not liable for any physical, emotional, financial, or other damages or losses you may experience.
- Your results are dependent on your own effort, motivation, and personal circumstances. We do not guarantee any specific outcomes.
3. Limitation of Liability
To the fullest extent permitted by applicable law, Positive Realist, its owners, employees, contractors, and affiliates disclaim all liability for any direct, indirect, incidental, consequential, or special damages arising from your use of or reliance on any of our services, content, or materials.
You expressly release Positive Realist from any and all claims, actions, demands, or liabilities, known or unknown, that may arise in connection with your participation in our coaching programs.
4. No Refunds or Returns
All sales are final. Positive Realist maintains a strict no-refund, no-return policy for all coaching programs, digital products, and services.
By purchasing a service, you acknowledge and agree that:
- You are committing to the full payment amount, regardless of your participation or results.
- No refunds, credits, or transfers will be issued for any reason, including dissatisfaction, non-use, or change of mind.
5. Payment Terms
All fees must be paid in full before services are rendered unless otherwise agreed in writing. Failure to make timely payments may result in suspension or termination of access to the program or services.
6. Session Expiration Policy
All purchased coaching sessions, packages, or credits must be used within six (6) months from the original date of purchase, unless otherwise agreed to in writing by Positive Realist, LLC. Any unused sessions or credits remaining after this six-month period shall be deemed expired and forfeited.
Expired sessions are non-transferable and non-refundable. Clients are responsible for scheduling their sessions within the valid usage period, and Positive Realist, LLC makes no guarantee of availability beyond the standard scheduling window.
7. Intellectual Property
All materials, methods, and content provided by Positive Realist remain the exclusive intellectual property of the Company. You may not copy, reproduce, modify, or distribute any materials without prior written consent from Positive Realist, LLC.
8. Confidentiality
We respect your privacy and will not disclose your personal information without consent, except as required by law. You agree to maintain the confidentiality of any proprietary or personal information shared during coaching sessions.
9. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.
You agree that any dispute, claim, or legal action arising from or related to these Terms or your participation in any Positive Realist service shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you hereby consent to the personal jurisdiction of such courts.
10. Acceptance of Terms
By accessing our website, enrolling in a program, or submitting payment, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full.
