Please read these Terms carefully. By using our Site or Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
1. Nature of Services
Positive Realist provides personal development, mindset, communication, and coaching services designed to support clients in self-improvement and reaching personal and professional goals. Our Services are educational and informational in nature and are not medical, psychological, therapeutic, legal, or financial advice.
Coaching is not a substitute for professional mental health treatment, medical care, legal representation, or financial consulting. You agree to seek appropriate professional support when necessary.
2. Client Responsibility and Assumption of Risk
By engaging in our Services, you acknowledge and agree that:
• You are participating voluntarily and at your own risk.
• You are solely responsible for your decisions, behaviors, and outcomes before, during, and after the coaching program.
• Any choices you make based on coaching sessions, materials, or recommendations are your own.
• Positive Realist is not liable for emotional, physical, financial, professional, or other outcomes or losses resulting from your participation.
• Personal results vary and depend on your effort, follow-through, motivation, personal circumstances, and level of engagement.
You assume full responsibility for any risks or consequences associated with your participation in coaching.
3. No Guarantees of Outcomes
Coaching is a collaborative process, and while Positive Realist provides guidance, tools, and support, we do not guarantee:
• Employment or job placement
• Acceptance to programs or visa approvals
• Specific communication, performance, or mindset outcomes
• Financial, professional, or emotional results
• Any particular transformation or measurable improvement
Any examples or testimonials shared on the Site or in marketing materials are illustrative only and not guarantees of your experience or results.
4. Limitation of Liability
To the fullest extent permitted by law, Positive Realist, its owners, employees, coaches, contractors, and affiliates disclaim any and all liability for:
• Direct, indirect, incidental, special, consequential, or punitive damages
• Losses or injuries resulting from the use of the Site or Services
• Decisions or actions taken based on coaching guidance, suggestions, or materials
• Any emotional or psychological response arising from participation in coaching
By participating, you expressly release Positive Realist from all claims or liabilities, known or unknown, arising from your use of the Services.
5. Introductory Packages for First-Time Clients
Positive Realist offers two introductory coaching packages exclusively for first-time clients:
Momentum Starter – $199
Includes a 45-minute coaching session, review of a client intake form, personalized assessment, and recommended next steps.
Transformation Path – $999
Includes four 60-minute sessions, a customized growth plan, accountability check-ins, priority support between sessions, and access to tools and resources.
These packages are introductory offers available only once per new client. Rates are promotional and may change at any time.
6. Payment Terms
• All fees must be paid in full at the time of booking unless otherwise agreed in writing.
• Payments are processed through secure third-party platforms.
• Failure to complete payments may result in suspension of Services.
• By submitting payment, you authorize Positive Realist to charge your selected payment method.
7. Refund and Cancellation Policy
• All sales are final. No refunds, returns, credits, or transfers will be issued for any reason, including dissatisfaction, non-use, or changes in personal circumstances.
• Sessions may be rescheduled with at least 24 hours’ notice. Sessions canceled with less than 24 hours’ notice may be forfeited.
• If Positive Realist reschedules a session, a new time will be provided at no additional cost.
• Multi-session packages cannot be paused, extended, or transferred without written approval.
8. Session Expiration Policy
All purchased sessions, packages, or coaching credits must be used within 90 days of the original purchase date unless otherwise agreed to in writing.
Unused sessions after 90 days will be considered expired and forfeited.
Expired sessions are non-refundable and non-transferable.
Clients are responsible for scheduling sessions within the active usage period. Availability is not guaranteed beyond standard scheduling windows.
9. Intellectual Property
All materials, content, exercises, videos, worksheets, strategies, and methodologies provided by Positive Realist are the exclusive intellectual property of Positive Realist, LLC.
Clients may not copy, reproduce, distribute, modify, or share these materials without written permission.
10. Confidentiality
Positive Realist values client confidentiality. We will not disclose your personal information without consent unless:
• Required by law
• There is risk of harm to self or others
• Disclosure is necessary to protect the Company’s legal rights
You agree not to share proprietary or personal information from coaching sessions or materials.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Nevada.
Any disputes arising from these Terms or Services shall be resolved exclusively in the state or federal courts of Clark County, Nevada.
By using our Site or Services, you consent to the jurisdiction of these courts.
12. Acceptance of Terms
By purchasing a coaching program, scheduling a session, or using the Site, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
